A Focused Process for Disputes at Impasse
Many cases do not need more procedure. They need a decision. ADR Virtual Arbitration provides enough process to be fair, but not so much process that the process becomes the problem.
Efficient
The matter proceeds on a written record with defined deadlines and no unnecessary procedural steps.
Binding
The parties agree that the selected final offer becomes the binding arbitration award.
Reasoned
The neutral explains why the selected offer better fits the record and the parties’ submissions.
How the Process Works
The procedure is intentionally simple. The parties submit the record, exchange final offers, and receive a written award.
Agreement to Proceed
The parties execute a short submission agreement identifying the issues to be decided.
Scheduling Order
Deadlines are set for written submissions, exhibits, responses, and final offers.
Written Submissions
Each side submits its facts, documents, legal argument, and proposed final offer.
Final Offer Selection
The neutral selects one offer in its entirety. There is no splitting the difference.
Reasoned Award
A written award explains the basis for selecting the prevailing final offer.
Case Closed
The parties receive finality without discovery, hearings, or extended litigation expense.
Appropriate Matters
Document-only final-offer arbitration is best suited for disputes where the principal disagreement concerns value, allocation, payment, responsibility, or the appropriate final outcome.
Commercial Disputes
Contract claims, payment disputes, vendor disputes, and business disagreements.
Construction Claims
Change orders, retainage, subcontractor disputes, and project payment issues.
LLC & Partnership Matters
Member disputes, buyouts, profit allocations, deadlock, and business separation issues.
Employment & Compensation
Commission disputes, wage claims, severance disagreements, and compensation issues.
Fee Disputes
Professional fee disputes and contested payment matters suitable for written review.
Matrimonial Financial Issues
Financial disputes where parties seek a private, efficient, document-based decision.
Roster of Neutrals
Matters are assigned to a roster of qualified neutrals, which may include attorneys, retired judges, former adjudicators, and industry professionals. The goal is to match the dispute with a neutral suited to the subject matter and the written record.
Attorneys
Experienced legal professionals available for commercial, civil, employment, and contract matters.
Retired Judges
Judicial experience for matters requiring disciplined review, neutral reasoning, and finality.
Industry Professionals
Subject-matter professionals for construction, business, valuation, and specialized disputes.
Flat-Fee Pricing
Fees are generally divided equally between the parties unless otherwise agreed. Final fees are confirmed after intake and review of the anticipated written record.
